Collecting personal information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual (including the information below) as "personal information".

Device information

  • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimise our Site.
  • Source of collection: collected automatically when you access our Site using cookies, log files, web beacons, tags and pixels.
  • Disclosure for a business purpose: shared with our processors Shopify (host platform) and Google Analytics 4.
  • Personal information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.

Order information

  • Purpose of collection: to provide the products you order, to process your payment, arrange shipping and provide you with invoices and order confirmations, to communicate with you, to screen orders for potential fraud, and — when in line with the preferences you have shared with us — to provide you with information or advertising relating to our products.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with Shopify (host and payment processing), the courier fulfilling your order (currently Royal Mail and, for international orders, our contracted international carriers), and Kit (email marketing platform).
  • Personal information collected: name, billing address, shipping address, payment information (including credit/debit card numbers), email address and phone number.

Customer support information

  • Purpose of collection: to provide customer support and to respond to your enquiries.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: handled internally by Smile Medicals Ltd. No third-party support tools are used.
  • Personal information collected: your name, email address, and the content of your message (including any information you choose to share about your order or usage).

Minors

The Site is not intended for individuals under the age of 16. We do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at the address above to request deletion.

Sharing personal information

We share your personal information with service providers to help us provide our services and fulfil our contracts with you, as described above. For example:

  • We may share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Behavioural advertising

We may use your personal information in the future to show you targeted advertisements or marketing communications we believe may be of interest to you. At the time of writing, we are not running paid advertising campaigns that track behaviour across other websites. If this changes, this Privacy Policy will be updated accordingly.

Using personal information

We use your personal information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfilment of your order, providing customer support, and — where you have opted in — keeping you up to date on new products, designs and offers.

Lawful basis

Pursuant to the UK GDPR and the EU General Data Protection Regulation (for EEA residents), we process your personal information under the following lawful bases:

  • Your consent (for example, when you subscribe to our newsletter);
  • The performance of the contract between you and us (for example, when you place an order);
  • Compliance with our legal obligations (for example, tax and accounting record-keeping);
  • Our legitimate interests, which do not override your fundamental rights and freedoms (for example, keeping the Site secure and improving it based on aggregate analytics).

Retention

When you place an order through the Site, we will retain your order information for our records for at least six years, as required by UK tax legislation. Automatic decision-making

We do not engage in fully automated decision-making that has a legal or otherwise significant effect on you. Our processor Shopify uses limited automated decision-making to help prevent fraud (for example, temporary blacklisting of IP addresses associated with failed transactions), but this does not have a legal or otherwise significant effect on you.

Your rights

UK & EU (GDPR)

If you are a resident of the United Kingdom or the European Economic Area (EEA), you have the right to access the personal information we hold about you, to port it to a new service, and to ask that your personal information be corrected, updated or erased. You also have the right to withdraw consent at any time where processing is based on consent, and the right to object to processing based on our legitimate interests. Your personal information will be initially processed in the United Kingdom and Ireland (Shopify's EU region) and may be transferred outside the UK/EEA for storage and further processing, including to the United States and Canada. Such transfers are protected by appropriate safeguards, including the UK International Data Transfer Addendum and the EU Standard Contractual Clauses.

Cookies

A cookie is a small piece of information downloaded to your device when you visit our Site. We use functional, performance and analytics cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). Cookies also provide information on how people use the website.

We use the cookies listed by Shopify's storefront implementation, which is kept current here: https://www.shopify.com/legal/cookies. In addition to Shopify's default cookies, we use Google Analytics 4 cookies (_ga, _gid, _gat) for analytics.
